City council to secure water line easements

DUNCAN — Tuesday night the Duncan City Council approved both the dedication of easements for the waterline improvements to the 2012 Osage Road Project and authorized the condemnation proceedings to secure easements for this project.

For the past several months, the city has been trying to contact property owners of the properties where access is needed to complete the project.

“There are certain individuals who we have not been able to contact,” Frieda said. “These individuals are property owners. There are several who have not responded to the city’s offer with regard to the right-of-ways. There are several who have disagreed with the values placed on that.”

To expedite the process, the council approved that condemnation proceedings begin to gain access to these properties.

“The process begins with the City of Duncan filing an action with the District Court and asking the court to appoint commissioners to  appraise the value of the properties,” Frieda said. “There are up to 60 days where property owners can ask for a jury trial if they object to the values placed on the properties. Subsequent to completion of that, if the property owner receives an award in excess of 10 percent than our appraiser has given us. We have to offer them and they are entitled to receive attorney fees also.”

Based on the action taken following the Duncan City Council’s Executive Session during Tuesday’s regular meeting, City Manager Jim Frieda has earned himself a raise.

The council adjourned into executive session to discuss the employment, hiring, appointment, promotion, demotion, disciplining or resignation of any salaried public officer or employee. Specifically, the performance of the city manager and determine a wage increase as given to other city employees.

As a result of the discussion, Frieda will be given a 5 percent salary increase in exchange for his continued service to the City of Duncan.

In other business, the council:

n Awarded contracts for shredding for city-owned facilities as follows: police complex, municipal court, personnel and finance departments at city hall to File Thirteen in the total amount of $90 per month.  File Thirteen will shred larger amounts for clean-outs at $.13 per pound.

n Ratified a resolution approving the biannual supplements to the permanent code of ordinances.

n Adjourned into executive session and later approved negotiations concerning the firefighters’ union IAFF Local 2929 for Fiscal Year 2013. Negotiations take place annually.

n Adjourned into executive session and later approved negotiations concerning the police union Fraternal Order of Police Oklahoma Lodge No. 99 for Fiscal Year 2013. Negotiations take place annually.
